Terms of service
Version 2026-09-28. These terms are the rules for providing services electronically within the meaning of the Polish Act of 18 July 2002 on providing services by electronic means. The Polish version prevails.
1. Definitions
- Operator: Bartlomiej Zubrzycki IT Services, Warszawa, NIP 9512298102, email divetheory@nopressurediving.com.
- Service or DiveTheory: the online service run by the Operator that supports teaching the theory part of diving courses.
- School: a diving instructor or diving school that registers in the Service. The person who registers is the Instructor.
- Student: a person whose account a School creates so that they can study in the Service.
- User: an Instructor or a Student.
- Pilot: the current phase of the Service, open only to Schools the Operator invites.
2. What the Service is, and what it is not
- The Service lets a School assign theory courses to its Students, lets Students study lessons and take quizzes and exams, shows the Instructor the Students' progress and weak topics, and lets the Instructor record remediation, assessments, and training records.
- The Service does not certify divers and does not replace training with an instructor. Theory learned in the Service must be discussed with the Instructor and supported by practical training in the water under the standards of the School's training organisation.
- Results in the Service show how a Student answered. They are not proof of diving competence. The Instructor alone decides whether a Student is ready and whether to certify them.
- Diving is dangerous. Never dive, plan a dive, or change dive practice on the basis of the Service's content alone.
3. Technical requirements
Using the Service requires an internet connection, an up-to-date web browser with JavaScript and cookies enabled, and an email address. The Operator does not charge for data transfer; that depends on the User's internet provider.
4. Accounts
- During the Pilot, only an Instructor whose email address the Operator has put on the list of invited Schools can register. Registration requires accepting these terms and the data processing agreement, and confirming the email address.
- A Student's account is created by the School. The Student receives an invitation by email and joins by setting a password and accepting these terms.
- The agreement to provide the Service is concluded when the User accepts these terms, and runs for an indefinite period.
- Each account is personal. Keep your password secret and tell the Operator at once if you think someone else has used your account.
5. The Pilot is free
- During the Pilot the Service is free of charge.
- The Operator may end the Pilot, or the Service, with at least 30 days' notice by email. Before it ends, a School may ask for a copy of its Students' data.
- Paid plans, if introduced, will require new terms and the School's express acceptance. A School will never be charged without having agreed to it.
6. The School's obligations
The School:
- is the controller of its Students' personal data and has a legal basis to enter it in the Service; informs its Students about the processing, including by pointing them to the privacy policy;
- when a Student is under 18, makes sure that a parent or legal guardian has agreed to the Student using the Service;
- enters accurate data and corrects it when needed;
- does not enter health data (for example medical questionnaire answers) or other special categories of personal data;
- uses the Service in line with the law and its training organisation's standards.
7. Rules for all Users
Users must not:
- provide unlawful content;
- try to access other Users' data or accounts, or to bypass the Service's security;
- overload or disrupt the Service, or access it with automated tools;
- copy, publish, or sell the course content outside the Service.
8. Course content
The course content (lessons, questions, images) belongs to the Operator or its licensors. Users may use it only within the Service for their own learning or teaching.
9. Availability and liability
- The Operator takes care that the Service works correctly, but during the Pilot it does not guarantee uninterrupted availability. Maintenance breaks will be announced where possible.
- The Operator is not liable for decisions about diving training, readiness, or certification; they are the Instructor's.
- Towards Schools that use the Service in their business, the Operator's liability is limited to damage caused intentionally or through gross negligence, as far as the law allows.
- Nothing in these terms limits the rights of consumers or the Operator's liability that cannot be limited by law.
10. Complaints
Complaints about the Service can be sent to divetheory@nopressurediving.com. Please describe the problem and give the email address of your account. The Operator answers within 14 days.
11. Ending the agreement
- A User may end the agreement at any time, without giving a reason and at no cost, by writing to divetheory@nopressurediving.com from the address of their account. A Student may also ask their School.
- When a School's account is closed, the accounts and data of its Students are deleted as set out in the data processing agreement.
- The Operator may end the agreement with a User who seriously breaches these terms, after asking them to stop and giving them at least 7 days to do so, unless the breach threatens the security of the Service or other Users.
12. Changes to these terms
The Operator may change these terms for important reasons, such as changes in the law or in the Service. Users will be told by email or in the Service at least 14 days before the change takes effect. A User who does not accept the change may end the agreement before then.
13. Final provisions
- These terms are governed by Polish law. A consumer keeps the protection given by the law of the country where they live, where that law requires it.
- Disputes with Schools that are businesses are settled by the court competent for the Operator's address given in section 1. Disputes with consumers are settled by the court competent under general rules.
- The provisions of these terms that apply to consumers also apply to a sole trader who concludes the agreement in connection with their business but not in a professional capacity, as far as Polish law provides.
